Terms of Service.

1. Acceptance of these terms

By using our website, signing up for a coaching programme, purchasing a supplement, or otherwise engaging Inception Nutrition, you agree to these terms. If you do not agree, do not use the services.

2. Who we are

Inception Nutrition Limited is a New Zealand company based at 65 Blenheim Road, Christchurch 8025. We provide nutrition coaching, training programming, longevity programmes, supplement products through Inception Labs, and educational content through the Nutrition Hub. Inception Nutrition is part of the Inception Group, alongside Inception Gym and Inception Labs.

3. What we provide

Coaching services, including Nutrition Coaching, Training Programming, Combined Coaching, and the Longevity Programme.
Supplement products through Inception Labs. Separate terms may apply to product purchases. See section 8.
Educational content through the Nutrition Hub and our newsletter.

4. Eligibility

Our services are for adults. To enrol, you must:

Be 18 years of age or older.
Not be pregnant or breastfeeding, unless you have written clearance from your GP or midwife to undertake the programme.
Not currently be in active treatment for an eating disorder. Nutrition coaching is not an appropriate intervention in that context, and we will refer you to suitable medical care if it is.
Disclose any medical conditions, medications, allergies, or injuries that may affect the safety or suitability of the programme.

We reserve the right to decline or end an engagement if we believe a programme is not safe or suitable for you, and to refer you back to your GP or to a registered health practitioner where appropriate.

5. Coaching programmes

5.1 Billing

Coaching programmes are billed weekly or monthly, depending on the programme you enrol in. Payment is taken in advance via the payment method you provide at signup. Failed payments may pause or end your access until the issue is resolved.

5.2 Initial commitment

Nutrition Coaching, Training Programming, and Combined Coaching run on an 18-week minimum initial commitment. The Longevity Programme runs on a 12-month initial commitment. After the initial commitment, programmes continue on a rolling basis until cancelled.

5.3 Cancellation

After the initial commitment, you can cancel a coaching programme by giving us at least seven days written notice. We do not pro-rata refund mid-cycle. Your access continues until the end of the current billing cycle.

5.4 Refunds and cooling off

For first-time signups to a coaching programme we offer a 14-day cooling-off period from the date of first payment, less a reasonable charge for any work already delivered (for example an initial scan, an intake review, or a personalised report). After the cooling-off period, services already delivered are not refundable.

Nothing in these terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

6. Medical disclaimer

Inception Nutrition provides nutrition consulting and body composition coaching. We do not diagnose, treat, or cure medical conditions. We work alongside your GP and recommend you continue medical care for any diagnosed conditions. Information on this site is educational and is not medical advice. Outcomes vary based on individual adherence and circumstances.

If you have a health condition or are taking prescribed medication, work with your GP. Do not start, stop, or change a prescribed medication based on anything we say. If you experience adverse symptoms while on a programme, stop and seek qualified medical advice.

7. Your responsibilities

Provide accurate and complete information when you sign up and on an ongoing basis.
Disclose any medical conditions, medications, or circumstances that may affect the safety or suitability of the programme.
Follow the programme as prescribed, or accept that outcomes will vary if you do not.
Keep your account credentials secure and tell us promptly if you suspect unauthorised access.
Pay your fees on time.
Treat our staff and contractors with respect. We reserve the right to end an engagement for abusive behaviour.

8. Supplements and Inception Labs

Supplement purchases through Inception Labs may be governed by a separate set of product terms covering pricing, shipping, returns, and product warnings. Where those terms apply they will be presented at the point of purchase and will sit alongside these terms. The medical disclaimer in section 6 applies to all supplement use.

9. Intellectual property

All content on this site and produced as part of our coaching services, including methodology, frameworks, articles, reports, meal plans, training programmes, and educational material, is owned by Inception Nutrition or our licensors. You receive a personal, non-transferable licence to use the content provided to you as part of your programme. You may not redistribute, resell, republish, or use it commercially without our written permission.

10. Limitation of liability

To the maximum extent permitted by New Zealand law, Inception Nutrition is not liable for indirect, incidental, special, or consequential losses arising from the use of our services, including loss of profits, loss of data, or loss of goodwill.

Our aggregate liability for any claim arising from or in connection with the services is capped at the total fees paid by you in the 12 months immediately before the event giving rise to the claim.

Nothing in these terms limits liability that cannot lawfully be excluded or limited under New Zealand law, including non-excludable rights under the Consumer Guarantees Act 1993.

11. Indemnity

You agree to indemnify Inception Nutrition against any claims, losses, or costs arising from your misuse of the services, your breach of these terms, or your provision of false or misleading information.

12. Termination

Either party can terminate a coaching engagement after the initial commitment by giving the notice set out in section 5.3. We can terminate immediately if you breach these terms, misrepresent your circumstances, fail to pay, or behave in a way that is unsafe or abusive. On termination, the licence in section 9 ends and you must stop using the materials we have provided.

13. Governing law and disputes

These terms are governed by the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction over any dispute. We encourage good-faith mediation before any party commences court proceedings.

14. Changes to these terms

We may update these terms from time to time. The current version will always be available on this page, with the last updated date at the top. Material changes will be notified by email to active clients and prospective clients on our list before they take effect. Continued use of the services after a change takes effect means you accept the updated terms.
